The second is where Australian law is specific. A commission or bonus is not a separate thing from wages. The Fair Work Act requires an employer to pay amounts payable for the performance of work in full, in money, and at least monthly, and its own note lists incentive-based payments and bonuses, loadings, monetary allowances, overtime and penalty rates among those amounts. A commission plan that pays quarterly in arrears with discretionary adjustments needs to be checked against that.

The award question sits underneath it. Where a modern award covers the sales role, the award's minimum rate for the classification applies regardless of what the commission plan says, and a low base topped up by variable pay can fall short in a bad quarter. A sales consultant who designs a plan without asking which award applies has left you carrying the risk.

Diagnosing a sales pipeline before redesigning it

Start with conversion between stages and time in stage, taken from the customer relationship system rather than from a manager's view. Most Australian mid-market sales teams have enough history for this even where nobody has run the numbers. The pattern is usually a single stage where deals stall, and a second where they are marked as progressed without any buyer action.

Then check how stages are defined. A stage that means the seller sent a proposal is a seller activity. A stage that means the buyer nominated a decision date and named who signs is buyer evidence. Forecasts built on the first kind are why sales leaders stop trusting the system.

Only then change anything, and change one thing. Redesigning the stages, the compensation and the territories in the same quarter makes it impossible to say which move worked, and it maximises disruption in the one function where disruption shows up in revenue within weeks.

Paying commission lawfully in Australia

The Fair Work Act requires an employer to pay amounts payable to an employee for the performance of work in full, in money, and at least monthly, by cash, cheque or similar order, electronic transfer, or a method authorised by a modern award or enterprise agreement. Where an award or agreement specifies a method, that method must be used.

The Act's note to that section states that the amounts covered include incentive-based payments and bonuses, loadings, monetary allowances, overtime or penalty rates and leave payments, if they become payable during the relevant period. So a commission that has become payable is wages, not a gift.

Pay slips must be given within one working day of paying an amount for the performance of work, and must include the information prescribed by regulations. Where commission forms part of pay, the pay slip has to show it properly. business.gov.au notes you may be fined for not providing a pay slip on time or not including the right information.

Commission plans that create legal exposure

  • A plan that lets total earnings fall below the applicable modern award minimum for the classification in a weak period.
  • Commission that is only payable if the employee is still employed at the payment date, where it has already become payable for work done.
  • Deductions from commission for costs that are not permitted deductions, since the Act requires payment in full subject to limited exceptions.
  • Quarterly or annual payment cycles that do not sit within the requirement to pay at least monthly for amounts that have become payable.
  • Targets set retrospectively or varied mid-period without agreement, which invites a dispute about what was payable.
  • Plans for contractors that in substance describe employment, given the Act's real substance and practical reality test.

Why sales incentive redesigns backfire

The usual failure is paying for the wrong event. A plan paying on signed contract with no clawback rewards deals that churn in three months. A plan paying on collected cash makes sellers chase invoices instead of selling. Pick the event you can live with and make the clawback or hold-back explicit in the plan document rather than in a manager's discretion.

The second failure is complexity. A plan with five components, two gates and a discretionary modifier cannot be modelled by the person it is meant to motivate. If a seller cannot calculate their own commission on a whiteboard, the plan is not an incentive.

The third is silence about the transition. Changing a plan partway through a cycle, for deals already in flight, is where disputes start. Set out what happens to in-flight deals in writing before the change takes effect.

Sales consultant, sales trainer or outsourced sales team

A sales consultant changes the system: stages, qualification, territories, compensation and reporting. A sales trainer changes the people, through coaching and skills work. Training a team to run a broken process faster does not help, so the sequence usually matters: fix the process, then train to it.

An outsourced sales or lead generation provider does the selling. That is a different commercial arrangement with different risks, including who owns the customer relationship, what happens to the pipeline if you end the contract, and whether the callers are following the telemarketing and commercial electronic message rules administered by the Australian Communications and Media Authority.

For a business with a handful of sellers, a short consulting engagement followed by internal coaching is usually better value than a long retained arrangement, because the system changes once and the coaching is continuous.

How sales consulting is charged

  • Fixed fee for a defined diagnostic and redesign, which is the cleanest structure for a one-off system change.
  • Day rate for coaching and call reviews, usually capped at a number of days a month.
  • Retainer for ongoing sales leadership where the business cannot yet justify a full-time sales manager.
  • Performance-linked fees, which need care because the consultant can influence how the measure is recorded.
  • Separate pricing for customer relationship system configuration, which is implementation rather than consulting.
  • Ask whether commission plan drafting is included, and whether it will be reviewed by an employment lawyer.

The Act requires payment in full, subject to limited permitted deductions, so a clawback that operates as a deduction from wages already payable is riskier than a plan that defines the commission as not yet earned until the qualifying event occurs. The safe path is to define the earning event clearly in the plan document and have an employment lawyer review it before it is issued.

Should I fix the sales process or the pay plan first?

The process, almost always. A compensation change is fast to make, visible and disruptive, and it will be blamed for everything that happens next. Stage definitions, qualification criteria and forecast discipline can be changed with much less noise and usually explain more of the problem. Change one thing at a time so you can tell which change did what.

What should a commission plan document contain?

The measure, the earning event, the payment timing, how the amount is calculated with a worked example, what happens on cancellation, refund or non-payment by the customer, what happens to in-flight deals if the plan changes, what happens on termination or leave, and who resolves disputes about it. If the seller cannot calculate their own commission from the document, it is too complicated to motivate anyone.

Do telemarketing rules affect an outsourced sales team?

Yes. Unsolicited calls and commercial electronic messages are regulated in Australia, with rules administered by the Australian Communications and Media Authority. If you outsource outbound calling or email campaigns, make the contract say who is responsible for compliance, require evidence of consent records, and do not assume a provider's list is clean because they say it is. The liability for messages sent on your behalf is not something you can contract away entirely.
