The Spam Act has three practical requirements. You need consent, either express or inferred in defined circumstances. Every message must identify the business that authorised it, using the correct legal name of the business or the name and Australian Business Number. And every commercial message must carry a working unsubscribe option that does not require the recipient to supply extra personal information or log in to an account, with withdrawal of consent taking effect at the end of five business days after the request is sent.

Check the footer in every template, not just the main one, and check it again after a rebrand or a company restructure.
The unsubscribe option must be functional, and it must not demand extra personal information or an account login. Withdrawal of consent takes effect at the end of five business days after the unsubscribe request is sent, so any process that holds requests in a queue for weekly processing is a problem. In a HubSpot portal this means opt-out has to be tied to the contact and its subscription types rather than to a single list, and every sending workflow must respect it.

So treat both as filters rather than evidence. Setting up a portal: properties, lifecycle stages and pipelines

Check the tier before designing. Feature availability, the number of workflows, custom objects, reporting depth and the marketing contact model all change between tiers, and pricing is affected by how many contacts are marked as marketing contacts. A design that quietly assumes a higher tier becomes an upgrade demand at launch, so ask the consultant to confirm which tier each proposed feature requires.
Choosing which hubs you actually need
HubSpot is sold as separate hubs for marketing, sales, service, content and operations, sharing one contact database. The shared database is the real benefit, and it is also the reason buying a single hub often works well: a sales team can use the CRM without the business paying for marketing automation nobody has time to run.
Buy the hub whose work you are actually resourced to do. Marketing automation with nobody to write the emails produces an expensive contact list. The common Australian pattern in small businesses is to start with the sales side, get the data and the pipeline honest, then add marketing once there is someone to own it.
Be wary of a consultant whose recommendation always lands on the highest tier of the most hubs. Ask which specific features in a proposed tier you will use in the first six months, and what the plan is if the answer turns out to be two of them.

- Duplicate contacts and companies created by forms and imports that match on the wrong field.
